“Vechten voor je kind. Vijf rechtszaken in Nederland mochten niet baten, en dan raak je je kind kwijt. Hoe verder als een vader?”

 

“Als twee goede vrienden en oud klasgenoten van Cliff Borger willen wij samen met hem aandacht vragen voor de volgende schrijnende situatie. Cliff bevindt zich momenteel in een enorm juridisch getouwtrek met de Filipijnse moeder van zijn dochter, Luna. Nadat Cliff heeft geprobeerd om in 2020 samen als gezin een toekomst op te bouwen in Nederland, liep de relatie door allerlei omstandigheden toch anders dan gepland. Nadat deze tot een einde kwam, zorgde Cliff ruim anderhalf jaar alleen voor zijn dochter in Nederland waar hij ook het ouderlijk gezag heeft over zijn dochter. Moeder was toen inmiddels weer terug in de Filipijnen. Luna draagt zowel de Nederlandse als de Filipijnse nationaliteit. Het meisje wordt in oktober 3 jaar. Cliff hield moeder op de hoogte over Luna met video’s, foto’s, e-mails. Na 7 maanden beschuldigde zij Cliff geheel onverwachts van kinderontvoering en verzocht zij de Nederlandse rechter voor een teruggeleiding van Luna naar de Filipijnen. Dit was de start van een oneindige juridische strijd die tot heden dag nog steeds gaande is”.

 

Advocaat en proces kosten

Cliff moest een advocaat nemen en werd hierbij tegen eigen wil gedwongen torenhoge kosten te maken, naast het feit dat hij als alleenverdiener, ook voor Luna zorgde en de volledige financiële verantwoordelijkheid bij hem lag. Moeder kreeg een gratis advocaat toegewezen van de Nederlandse staat aangezien zij een moeder is van een Nederlands kind en zij geen inkomen had. De Nederlandse overheid faciliteert dan rechtsbijstand en stelt vervolgens een gratis advocaat ter beschikking. Aangezien het inkomen van Cliff niet voldeed aan de voorwaarden kon hij niet in aanmerking komen voor deze regeling, en moest hij zelf voor alle advocaat- en proceskosten opdragen. Cliff voelt zich dan ook in de steek gelaten door zijn eigen land. Een buitenstaander die vrij weinig tot geen band met Nederland heeft wordt opgevangen in een financieel vangnet en wordt ondersteund door de overheid terwijl Cliff als Nederlander aan de kant wordt geschoven. Zo is het in Nederland geregeld.

 

Van mediation tot aan het Gerechtshof

Een poging tot mediation met moeder was ook niet succesvol. Alle mogelijke omgangsregelingen die Cliff heeft aangeboden werd niet mee ingestemd door moeder. De zaak werd voorgeleid bij de rechter.

 

Het Nederlands Rechtssysteem

De Rechtbank in Den Haag wees het verzoek tot teruggeleiding onverhoopt toe en Luna moest terug. Cliff voelde zoveel onrecht en ging in hoger beroep bij het Gerechtshof in Den Haag. Met veel moeite heeft hij deze gerechtelijke kosten van de eerste en tweede aanleg net kunnen betalen. Dit zijn geen bedragen van EUR. 5,000. Dit mag verzesvoudigd worden. Na een lange juridische battle werd met veel onbegrip en groot verdriet de beschikking van de rechtbank door het Het Gerechtshof bekrachtigt. Ook zij vonden dat Luna terug naar de Filipijnen moest. Een onbegrijpelijk besluit aangezien Cliff duidelijk had aangetoond dat er sprake was van een onstabiele en onveilige leefomgeving waarin Luna terecht zou komen, dat er een grote kans zou zijn dat het contact tussen Luna en haar vader door moeder zou worden verbroken en dat dit alles is niet in het belang van Luna zou zijn. Er is overigens ook geen verdrag tussen Nederland en de Filipijnen dus de rechters konden ook niet nagaan waar Luna exact terecht zou komen. Een zeer onbegrijpelijke beslissing die niet te verteren is want hoe kan een Nederlands kind uit een stabiele omgeving worden weggehaald om haar vervolgens in een gebied te plaatsen waar de veiligheid en stabiliteit niet gegarandeerd kunnen worden? Het ging geweldig met Luna in Nederland. Zij ging naar de kinderopvang en ontwikkelde zich op alle vlakken uitstekend. Het was een gelukkig meisje. In Nederland wordt er in dit soort situaties alleen rekening gehouden met de algemene belangen van het kind (kind moet terug naar het land waar het geboren is, en is nog “niet geworteld” in de Nederlandse samenleving), maar er wordt niet gekeken naar de individuele belangen (veiligheid, stabiele leefomgeving, huidige sociale en familiare banden, levenskansen, goed onderwijs etc.). Het Nederlandse rechtssysteem schiet hierbij te kort aan een aantal zaken en rechters zouden meer moeten inzoomen op de daadwerkelijke situatie en er niet maar van uitgaan dat alles wel goed zal komen nadat het kind is teruggeleid. Een case-to-case beoordeling zou dan uiteindelijk leiden naar wat het beste is voor het kind. Er wordt veels te veel uitgegaan van de standaard en de consequenties zijn onkenbaar groot en niet meer te overzien. Uiteindelijk wordt het kind het slachtoffer doordat er verkeerde overwegingen en beslissingen worden gemaakt.

 

Media en Ministerie

Als vader liep hij tegen hele hoge muren op. Cliff zocht uiteindelijk de media op en werd geïnterviewd door het televisieprogramma SBS6 Hart van Nederland. Ook verschenen er artikels in verschillende nieuwsbladen om zijn situatie met het Nederlands publiek te delen. Daarnaast startte hij een online petitie waarop hij veel positieve reacties en steun ontving. Cliff nam contact op met Minister Ferdinand Grapperhaus, Staatssecretaris Ankie Broekers en zelfs Koning Willem-Alexander om zijn persoonlijke situatie te bespreken en vraagt om hulp. De Koning heeft kennis genomen van de situatie maar er werd aangegeven dat hij niet de autoriteit heeft om beslissingen van het Hof te doen beïnvloeden. In cassatie gaan bij de Hoge Raad was ook geen optie en een verzoek bij het Europese Hof van de Rechten van de Mens kon hij financieel niet rondkrijgen.

 

Kort Geding

Cliff liet het er niet bij zitten en spande een kort geding aan voor een schorsing van het besluit van het Hof. Hiervoor gebruikte hij zijn laatste spaargeld dat hij nog over had, om een poging te wagen zijn dochter in Nederland te houden. Cliff toonde nogmaals aan hoe de levenssituatie van Luna eruit zou komen te zien in het woongebied van moeder door middel van nieuwe feiten en beeldmateriaal. Dit kon en mocht Luna niet worden aangedaan. Luna en Cliff zijn immers zeer gehecht en emotioneel verbonden met elkaar. Hij was Luna’s primaire hechtingspersoon. De Rechtbank Noord-Holland zag geen gronden om het besluit van het Hof te schorsen en beval de teruggeleiding 4 weken na de uitspraak. Cliff was niet in staat om Luna terug te brengen en moeder had onvoldoende financiële middelen om Luna op te halen in Nederland. Daarnaast maakte de pandemie en de reisbeperkingen een teruggeleiding niet mogelijk. Er gingen weken overheen maar Cliff kon de uitspraak van het Hof niet verteren, en dat dit zomaar kan in Nederland. Het land waar de rechten van de mens zo "hoog" in het vaandel zouden moeten staan en waar kinderrechten als prioriteit worden geacht. Niks van dit zag Cliff terug in de beslissingen. Nadat weken verstreken zag zijn advocaat nog mogelijkheden voor een nieuw kort geding en met hulp van anderen heeft Cliff deze advocaat kosten kunnen dekken. Het lukte hem een tweede kort geding aanhangig te maken. Het is ongelofelijk maar ook dit kortgeding werd afgewezen aangezien de voorzieningenrechter niet zomaar de beslissing van het hof kon veranderen. De ingebrachte nieuwe omstandigheden en feiten werden ook door deze rechter van de tafel geveegd en niet gezien als redenen om Luna in Nederland te houden en om zo haar veiligheid en levenskansen te waarborgen. Alleen wanneer er bijvoorbeeld oorlog in de Filipijnen zou zijn, dan zou het een rechtsgeldige grond zijn om Luna hier te kunnen houden en de uitspraak van het Hof te schorsen dan wel te vernietigen. Ondanks alle teleurstellingen, heeft Cliff altijd zijn medewerking getoond en nooit de uitspraak van het Hof genegeerd. Hij maakte gebruik van zijn recht om in hoger beroep te gaan en om voor zijn dochter te vechten.

 

Hoofdverblijf Luna in Nederland

Er zou ook nog een zitting komen om Luna’s gewone verblijfplaats en hoofdverblijf in Nederland vast te stellen maar 1 dag voordat deze zitting plaats zou vinden, werd Luna door Politie en de Koninklijke Marechaussee op een mensonwaardige wijze bij Cliff weggehaald en naar de luchthaven van Schiphol gebracht. Moeder was onder begeleiding en met hulp van de Filipijnse Ambassade Den Haag onaangekondigd naar Nederland gekomen om Luna mee terug te nemen naar de Filipijnen. Er was door de rechtbank geen omgangsregeling vastgesteld. Uit de praktijk blijkt nu dat het Nederlandse rechtssysteem dus niet zo'n grote waarde hecht om een kind gegarandeerd omgang met beide ouders te laten hebben. Dit zou wel aandacht moeten krijgen. Zeker als er gezamenlijk gezag is door beide ouders in Nederland. De overdracht van Luna was op 1 maart van dit jaar. Die dag was hartverscheurend en heeft Luna emotioneel enorm verward.  De Officier van Justitie wilde de zaak aangaande het hoofdverblijf wel aanhouden en deze vond plaats op 25 april van dit jaar. Hierin sprak de rechter uit dat zij niet bevoegd meer was om hier een beslissing over te kunnen nemen aangezien Luna inmiddels al onder de Filipijnse wet zou vallen. Echter, is dit onjuist, want op het moment dat het verzoek werd ingediend was Luna nog steeds in Nederland en kon de rechter dus weldegelijk een beslissing hierover nemen. Daarnaast verbleven moeder en Luna niet op tijdelijke basis in Nederland. Het plan was om zich permanent te vestigen in Nederland wat dus betekent dat Luna’s gewone verblijfplaats en hoofdverblijfplaats zijn veranderd na vestiging in Nederland. Zijn Nederlandse advocaat ziet daarom ook nog steeds aanknopingspunten en Cliff gaat momenteel weer in hoger beroep bij het Gerechtshof in Amsterdam. Deze zaak zal plaatsvinden in het najaar.

 

Cliff procedeert al een jaar lang in Nederland waarbij hij niet alleen zijn dochter is kwijtgeraakt maar ook een bedrag van ruim EUR. 50.000 aan proceskosten. Moeder bevestigde in de rechtbank dat Cliff altijd welkom zou zijn in de Filipijnen en dat hij Luna ten alle tijden kan bezoeken. Maar de werkelijk is helaas het tegenovergestelde. Er is weinig tot geen contact tussen Cliff en Luna aangezien de moeder fysieke omgang tussen Cliff en Luna niet toelaat. Alles wat Cliff probeerde om in contact te komen lukte niet. De moeder heeft volgens Filipijns recht het eenhoofdig gezag en als ongehuwde vader staat hij onderaan de ladder. Moeder heeft de volledige regie in handen.

 

Bezoek aan de Filipijnen

Dit heeft Cliff uiteindelijk doen besluiten om in mei van dit jaar af te reizen naar de Filipijnen. Een Filipijnse collega, waar Cliff destijds mee samenwerkte bij de internationale school daar, heeft samen met hem in Manilla een plan gemaakt om met Luna in contact te komen en om het financiële ondersteuning te continueren. Vervolgens vlogen ze naar het eiland Mindanao, het eiland waar moeder en Luna wonen. Moeder gaf Cliff geen toestemming om contact met Luna te hebben.  Dit ondanks het feit dat er eerder werd aangegeven dat Cliff zijn dochter altijd kon bezoeken in de Filipijnen. Cliff heeft vervolgens een Filipijnse advocaat moeten nemen en een verzoek tot omgang ingediend bij de Filipijnse rechter. De kosten van deze rechtszaken in de Filipijnen lopen enorm op en dit kan Cliff niet meer blijven volhouden. Daarnaast zijn de kosten van vliegtickets en hotels in deze dure tijden ook enorm gestegen, en deze uitgaven komen er nog allemaal bij.

De Filippijnse rechter besloot in een spoeddebat om Luna op humanitaire gronden haar vader nog even te laten zien voordat hij terugreist naar Nederland. Twee dagen van de twee maanden dat hij in de Filipijnen was. Luna was ontzettend blij om met haar vader weer te zien en deze hechte vader-dochter band mag niet geschaad of verstoord worden. Op 28 september 2022 vindt de hoorzitting over visitatierechten in de Filipijnen plaats waar Cliff fysiek bij aanwezig moet zijn. Via deze crowdfunding willen wij Cliff helpen zodat hij de kosten van de komende rechtszaak in beide landen en alle nog te maken kosten in de toekomst kan blijven dragen met als doel in het leven van zijn dochter te zijn. "Fighting for your child. Five court cases in the Netherlands were overturned, and then you lose your child. How to proceed as a father?"


""As two close friends and former classmates of Cliff Borger, we want to join him in calling attention to the following distressing situation. Cliff is currently in a huge legal tug-of-war with the Philippine mother of his daughter, Luna. After Cliff had tried in 2020 to build a future together as a family in the Netherlands, the relationship, due to all kinds of circumstances did not worked out. After the break up, Cliff took care of his daughter in the Netherlands on his own for more than a year and a half, where he also has parental custody over Luna. Mother had by then already returned to the Philippines. Luna has both Dutch and Philippine nationality. The girl will be 3 years old in October. Cliff kept the mother informed about Luna with videos, photos and emails. After 7 months, she completely unexpectedly accused Cliff of child abduction and requested the Dutch court for a return of Luna to the Philippines. This was the start of a never-ending legal battle that is still going on today".

 

Lawyer fees and process expenses

Cliff had to hire a lawyer and was forced to incur very high costs against his own will, in addition to the fact that as a single earner, he also took full care of Luna and the entire financial responsibility lay with him. Mother was assigned a free lawyer by the Dutch government since she is a mother of a Dutch child and had no income. The Dutch government then facilitates legal aid and then provides a free lawyer. Since Cliff's income did not meet the conditions, he could not qualify for this arrangement and had to pay for all the lawyer's fees and litigation costs himself. Cliff feels abandoned by his own country. An outsider with little or no connection to the Netherlands is taken care of in a financial safety net and is supported by the government while Cliff, as a Dutch citizen, is pushed aside. That's how it is arranged in the Netherlands.

 

From mediation to the Court of Appeals

An attempt at mediation with the mother was also unsuccessful. All possible visitation arrangements that Cliff offered were not agreed to by the mother. The case was brought before the court.

 

The Dutch Legal System

The District Court in The Hague unexpectedly granted the request for return and Luna had to go back. Cliff felt so much injustice and appealed to the Court of Appeal in The Hague. With great difficulty he just managed to pay the legal costs of the first and second instance. These are not amounts of EUR. 5,000. This may be increased sixfold. With a lot of incomprehension and sadness, the Court of Appeal upheld the decision of the court. They also found that Luna had to return to the Philippines. An incomprehensible decision since Cliff had clearly shown that the environment in which Luna would be transfered to was unstable and unsafe, that there was a big chance that her mother would cut off contact between Luna and her father, and that this was not in Luna's best interest. Besides, there is no treaty between the Netherlands and the Philippines so the judges could not find out where exactly Luna would end up. A very incomprehensible decision, because how can a Dutch child be taken away from a stable environment and then placed in an area where safety and stability cannot be guaranteed? Things went great with Luna in the Netherlands. She went to the Nursery school and developed excellently in all areas. She was a happy girl. In the Netherlands, in this kind of situation, only the general interests of the child are taken into account (child must return to the country of birth, and is not yet "rooted" in Dutch society), but no consideration is given to the individual interests (safety, stable living environment, current social and family ties, life chances, good education and so on.). The Dutch legal system really falls short on a number of issues here and judges should zoom in more on the actual situation and not just assume that everything will be fine after the child has been returned.  A case-to-case assessment would then ultimately lead to what is in the best welfare of the child. There is far too much assumption of the standard and the consequences are massive and out of control. In the end, the child is victimized because wrong considerations and decisions are made.

 

Media and Ministry

As a father, he ran into very high walls. Cliff eventually sought out the media and was interviewed by the television program SBS6 Hart van Nederland. Articles also appeared in various newspapers to share his situation with the Dutch public. He also started an online petition on which he received many positive reactions and support. Cliff contacted Minister Ferdinand Grapperhaus, State Secretary Ankie Broekers and even King Willem-Alexander to discuss his personal situation and ask for help. The King has taken note of the situation but it was indicated that he does not have the authority to influence decisions of the Court. Going to the Supreme Court in cassation was also not an option and a request to the European Court of Human Rights he could not manage financially.

 

Summary Proceedings

Cliff did not leave it at that and initiated summary proceedings to obtain a suspension of the Court's decision. He used his last remaining savings to try and keep his daughter in the Netherlands. Cliff once again demonstrated what Luna's living situation would be like in mother's home country and showed this by means of new facts and visual material. This could not and should not be done to Luna. After all, Luna and Cliff were very attached and emotionally connected. Cliff was Luna's primary parenting person. The North Holland District Court saw no grounds to suspend the Court's decision and ordered the return 4 weeks after the ruling. Cliff was unable to bring Luna back and mother did not have enough finances to pick up Luna in the Netherlands. In addition, the pandemic and travel restrictions did not make a return possible. Weeks passed but Cliff could not digest the Court's ruling, and that this could just happen in the Netherlands.The country where human rights are supposed to be on a "high" level and where child rights are considered a priority. Cliff saw none of this in the decisions. After weeks had passed, his lawyer saw possibilities for a new summary procedure and, with the help of others, Cliff was able to cover his lawyer's fees. It is incredible but also this proceeding was rejected as the judge of interim relief could not simply change the decision of the court. The new circumstances and facts that were brought forward were also dismissed by this judge and were not seen as reasons to suspend the decision and thus to guarantee Luna's safety and life chances. Only if there was a war in the Philippines, for example, would this be a valid reason to keep Luna here and to suspend or reverse the Court's ruling. Despite all the disappointments, Cliff always showed his cooperation and never ignored the Court's ruling. He exercised his rights to appeal and fought for his daughter.

 

Luna's main residence in the Netherlands

There would also be a hearing to establish Luna's habitual residence and main place of stay in the Netherlands, but one day before this hearing Luna was taken away from Cliff by the Police and the Military Police in a humiliating way and taken to Schiphol Airport. Mother had come to the Netherlands unannounced to take Luna back to the Philippines, accompanied and assisted by the Philippine Embassy in The Hague. No visitation arrangement had been established by the court. Practice now shows that the Dutch legal system does not place such a high value on a child being guaranteed access to both parents. This should be given attention. Especially when there is joint custody by both parents in the Netherlands. The transfer of Luna was on March 1 of this year. That day was heartbreaking and has left Luna emotionally very confused. The prosecutor wanted to continue the case regarding the main residence and this took place on April 25 of this year. The judge stated that she was no longer competent to make a decision on the matter since Luna was already subject to Philippine law. However, this is incorrect, because at the time the request was submitted Luna was still in the Netherlands and the judge could therefore still take a decision on the matter. In addition, mother and Luna did not reside in the Netherlands on a temporary basis. The plan was to settle permanently in the Netherlands, which means that Luna's habitual residence and main residence changed after he settled in the Netherlands. His Dutch lawyer therefore also still sees grounds for petition and Cliff is currently appealing again to the Court of Appeal in Amsterdam. This case will take place in the autumn.

 

Cliff has been litigating in the Netherlands for a year now, losing not only his daughter but also an amount of over EUR. 50,000 in litigation costs. Mother confirmed in court that Cliff would always be welcome in the Philippines and that he could visit Luna at all times. But the reality is unfortunately the opposite. There is little to no contact between Cliff and Luna as the mother does not allow any physical contact between Cliff and Luna. Everything Cliff tried to do to get in touch with his daughter was unsuccessful. Under Philippine law, the mother has sole custody and as an unmarried father he is at the bottom of the ladder. Mother is in complete control.

 

Visit to the Philippines

This finally led Cliff to travel to the Philippines in May of this year. A Filipino colleague, whom Cliff was working with at the time at the international school there, made a plan with him in Manila to get in touch with Luna and to continue financial support. Then they flew to the island Mindanao, the place where mother and Luna live. Mother did not give permission for Luna to be in contact with Cliff. This was despite the fact that it was previously indicated that Cliff could always visit his daughter in the Philippines. Cliff then had to hire a Filipino lawyer and file a case for visitation with the Philippine court. The costs of these court cases in the Philippines are running up quite a bit and this is something that Cliff can no longer sustain. In addition, the cost of airfare and hotels have also skyrocketed in these expensive times, and these expenses are all adding up. The Philippine judge decided in an urgent motion to let Luna see her father for a short time before he travelled back to The Netherlands, under humanitarian grounds. Two days out of two months that he was in the Philippines. Luna was extremely happy to see her father again and this close father-daughter bond should not be harmed or disturbed. On September 28, 2022, the hearing on Visititation Rights in the Philippines will take place where Cliff must be physically present. Through this crowdfunding, we want to help Cliff so that he can continue to cover the costs of the upcoming court proceedings in both countries and all the costs yet to be incurred in the future with the goal of being in his daughter's life.
